Contract proposals 2008

1. Article 1. Add to first paragraph "policies written and distributed by MTA management are applied equally to management as well as ATU Local 1300 members.

2. Article 4. Section I.  Add new the failure of MTA or the Union to honor the time requirements established in this Article shall constitute a forfeiture of its position.

3. Article 4. Section 2. (A) [Add after current language ] With the exception of discipline that arises from vehicular accidents, MTA must impose discipline against an employee within five working days after the event that serves as the basis for discipline. Otherwise, no discipline may be imposed. For discipline that arises as the result of vehicular accidents, MTA must impose discipline within thirty calendar days after the date of the accident: otherwise, no discipline may be imposed.

4. Article 2. Section G. it is understood that hearings under paragraphs © and (f) shall be in accordance with the provisions of the contract for the disposition of the subject grievance. 72 hours prior to a first level hearing of the grievance or discipline, the Union shall be provided with copies of any and all documents or reports relied upon by Management is determination of the case being heard.  MTA's failure to timely supply such information to the Union in accordance with this paragraph will prohibit MTA from relying upon, or entering in evidence, such information at any later stage of the grievance process, including arbitration.

5. Article 6. Section 2. Add grandchildren in 1st paragraph and change 3 days to 5 day entitlement and 1 day to 3 days.

6. Article 6. Section 1. Paragraphs 1 to change the number of officers on indefinite leave to 6 instead of 5.

7. Article 6. Section 2. Changes without loss of pay to will be paid what they would have earned and make paragraph 2 the same.

8. Article 6. Section 3. Second sentence to read the employees shall be paid their actual pay they would have received if working.

9. Article 6. Section 3. Changes 2 personal leave days to 7. Change second paragraph to carry over unlimited personal leave days and be able to be excused for 2 personal leave days annually without approval.

10. Article 6. Section 3. Add new section employees may switch day off for immediate family i.e. Doctor, Dentist, Lawyer appointments etc., etc. not to exceed 2 per quarter.

11. Article 9. Section IB. By the American Arbitration Association, which shall make the selections as expeditiously as possible upon written request of either party. Through the processes of the Federal Mediation and Conciliation Service, whereby the moving party will request a panel of seven arbitrators, all of whom are members of the National Academy of Arbitrators. Once the panel is received, the parties shall alternately strike names from the panel until one name remains, who shall serve as the arbitrator for the subject case.

12. Article 9. Section 6. In the event of an Arbitration Award against MTA, the parties shall have 60 days of the date of the Award to attempt to mutually resolve any remedial issues. In the event the parties are unable to agree on a remedy, the case shall be reassigned to the Arbitrator that issued the Award within 90 days of the date of the Award. A hearing will only be held if deemed necessary by the Arbitrator, after consultation with the parties' representatives. The arbitrator shall issue a Remedial Order, which must include interest, compounded daily at the Maryland State judgment interest rate in effect on the date of the Remedial Order. MTA shall be required to comply with the Remedial Order within 30 days of it issuance. Liquidated damages at the rate of 10% of the total Remedial Order will be assessed in the event MTA fails to comply with the time requirements in this section. Time requirements herein may be extended by mutual agreement.

13. Article 10. Section 2. If after MTA's doctor reports his findings, the Union requests in writing further consideration of the physical or mental qualifications of any employee concerning the employee's fitness for return to work or eligibility for sick leave, the following procedure shall be followed:

   

       a.)    If there is a conflict between MTA's doctor and the employee's doctor, then each respective doctor will review the case with each other to attempt to resolve the conflict. (If, after making a good faith attempt, the Union is unable to secure the employee's doctor's participation in the review process, or if the doctor's participation can only be secured at an unreasonably high cost, this subsection is, in such case, inapplicable,  and the Union may invoke the provisions set forth in subsection (b). Should no final decision be reached by this review then,

      b.)    Within ten (10) working days from notification of the results of the above review (or the date on which the Union is unable to fulfill the conditions of subparagraph (a) for the   reasons stated therein), either party, should it desire to utilize a third doctor, must notify the other party in writing of the desire for a third doctor's opinion and state the points in   dispute. If either party fails to make a timely request, the right shall be forfeited. Upon timely notification, the MTA (or its doctor) and the Union (or the employee's doctor)   shall jointly select a third doctor to review the case. The third doctor's opinion as to fitness for duty shall be final and binding on all parties.

14. Article 10. New section 20% of employees in all departments and locations no CDL requirements (disabled only).

15. Article 28. Section 12 (new). System Pick In the event of a major operational change affecting the work system wide, such as the opening or closing of a division, the reconfiguration or relocation of a substantial number of lines (as in the Greater Baltimore Bus Initiative), or other comparable change, there will be a system pick. Operators will be permitted to select work at any Division, in seniority order. The operator with the greatest overall seniority shall select a run of his choice or the Extra List at any Division, in accordance with his seniority, provided he can quality for the work selected; then the operator next in seniority shall make his selection, and so on down the list. Renumber as Section (13) Biddable Trippers.

16. Article 18. Option D to eliminate the need for a beneficiary.

17. Article 16. Welfare Section (3). Written application for paid sick leave must be made by the employee on a form provided by MTA. An employee who wishes to be placed on sick leave, also known as the sick list must contact MTA and advise MTA of his/her request to be placed on the sick list and the reason, and must submit the form applying for sick leave as soon thereafter as the employee can physically appear at MTA's premises. That form must be accompanied by a certificate signed by a duly qualified physician who attended the employee during the period of his/her illness or injury, stating the diagnosis and / or ICD9 of the illness or injury, the beginning and ending days the employee was under the physicians care, and the date when the physician considers the employee able to resume his/her normal duties. The form, as well as the doctor's certificate must be submitted either by hand or delivery or by mail, not by facsimile. The employee may ask another person to deliver the form and certificate if the employee is unable to do so.  No employee will be asked to appear for any disciplinary interview while on sick leave or the sick list. No employee will be removed from sick leave or the sick list without a medical examination, as provided in Article (10).

18. Article 16. Section 2. Change 12 days of sick leave to 15 days.

19. Article 16. Section 2. Sick leave change to get paid for 1 day sick and no occurrence on sick day.

20. Article 16. Section 1. Add Laser surgery

21. Article 16. Section 3. Dental benefit annual contract year maximum should be increased to $3,000.00 and add pay for dental implants.

22. Article 16. Section 2. Sickness and Accident fund employees receives $300.00 per week.

23. Article 16. Change active to $4,000.00 pensioners to $3,000.00.

24. Article 16. An employee desiring to return from pension upon being medically qualified will be reinstated based only on medical qualifications standards.

25. Article 17. Section 1A. Change 167 days to 120 days.

26. Article 17. Vacations.

 27. Vacations will be paid at the rate your normal assignments pay.

28. In lieu of being forced to sell back vacation and personal leave days you are allowed to carry them over and to be used at the first available time.

29. Article 18. Remove cap and change multiplier 3 times 7/1/08 1.17, 07/09 1.18, and 7/10 2.00.

30. Pension adjustments change from 3% to 4 %.

31. Article 18. changes in the calculation for pension's time on leave of absence to serve as a full time elected official for local 1300 will be allowed the rate of 60% of a year's salary.

32. Lump sum payment of accrued sick time at retirement is paid out 100% at 8 hours for each day.

33. Article 18. Section 4. Addendum Service definitions add to the end of paragraph 6 last sentence to read add state time to credited service and up to 4 years of military time.

34. Article 18. change last paragraph to read Local 1300 will be allowed at the rate of 3210 hours instead of 2210.

35. Surviving Spouse Pension change first sentence to read if an employee dies prior to retirement but after being vested leave the rest as is.

36. Article 18. Delete penalties for early retirement.

37. Spouse should continue to receive health insurance for the remainder of his / her life.

38. 25 years and out to receive full pension.

39. Increase monthly pension allowance from $58 to 7/08 $78: 7/09 $88 and 7/10 $98.

40. Full retirement age + years of service should equal 80 instead Early retirement age + years of service should equal 82.

41. Article 47. Part timer's service for pensioner purposes should be changed to 160 hours of credited service.

42. Pensioners get 5% increase yearly and use the inflation index.

43. Disability pension should be $1000.00 minimum per month.

44. Pension eligibility - normal retirement last sentence to read the minimum monthly pension of an employer who retires at age 65 with not less than 25 years of continuous service shall be $1500.00 per month.

45. All retirees are eligible to return as part time bus operators.

46. Article 21. Section2. Change meal allowance to $10.00 During all work in sleet and snow meal allowance will be paid every (5) hours. Eliminate MTA may elect to furnish such meal in lieu of meal allowance.

47. Article 24A. To read the Union Hall must receive all contracts concerning contractors on MTA's premises.

48. Article 24A. Proposal to promote efficiency and harmony in productivity. MTA must include Local 1300 in the planning process of all work before any work is sub contracted out. MTA will pay a daily stipend to all employees involved for failing to comply with this section.

49. Article 25A. New Section add Mobility Division The principles and provisions of Part II of the Labor Agreement ("Provisions for Operators") shall apply to all Mobility Division Operators, and to all operators an other employees assigned to the Mobility Division who are covered by the labor agreement.

50. Article 25. Section2. Allows MTA operators to carry 50% of the mobility rider ship.

51. Article 25. Section1. When an operator receives a add on that causes them to pull in late will be paid a minimum of 2 hours if less and actual time for all over 2 hours.

52. Article 25A. Section3. Probationary period for operators bidding into mobility will be 90 days.

53. Article 31. Section2. 3rd Paragraph Add new sentences to read 1st or 2nd part not to exceed 4 1A hours.

54. Article 35. Section A. Additional pull out time increased by 3 minutes change 7 minutes to 10 at Bush St 9 minutes to 12 and 12 to 15 14 minutes to 17 at Bush Street.

55. Article 36. Section 1. Change (8) consecutive hours to 10 hours.

56. Article 40. Section 3 (A). Add after word listed employees who work such holiday shall receive time and l/2 for all time worked make same correction in Article 57 Section 3A.

57. Article 40. Group 2. Clarify it to include Brake Shop 58. Article 45 Accidents dropped from your record after 2 years on your record, public complaints and all other violations after 6 months.

59. Article 46. Section 2. Uniforms Uniform allowance should be changed to $425.00 yearly.

60. Article 49. Merge groups 2 & 3

61. Article 50. Group 2. Bidding procedure change first sentence to include A,B,C employees in group 1,2, and 3.  

Group 3 "A" add A, B, C, in groups 1, 2, 3. Group 6 second sentences the "A" job that is  left open to be advertised to the B, C, Janitors and Laborers in group  6. All testing is to be completed in the group prior to posting open jobs.

62. Article 50. Section H. To be deleted.

63. Article 50. Section 1A. Add after award bulletin no later than 30 days.

64. Article 52. Section 1. To add after 55% of the employees to be off by classification will receive either etc., etc.

65. Article 52. Section 3A. Change without regard to seniority to with regard to seniority.

66. Article 52.  2 shop people on service calls after 8 pm and 2 on tow truck calls at all times.

67. Article 53. Change from .60 cents to $1.75 for Lead man pay. Lead man will have no disciplinary authority and will not participate in any action relating to possible disciplinary action involving another union member.

68. Article 54. Section 5. Add after Personal leave, Sick 1 day, work related injuries and all subsequent appointments.

69. Article 55. New section 3 delete and revert back to previous provisions.

70. Article 55. Section F. To read for Day off Employee will be informed to be notified of all open work and given a 2 day notification.

71. Article 58. Third paragraph change from 10 cents to 50 cents and add when performing all storm related work.

72. Article 58. last paragraph change 6 to 8 hours off.

73. Article 59, R 29, LR 29. Management must provide transportation and or 1 hour pay each way in all groups.

74. Article 60. Add new paragraph that reads accessory allowance of $30 for inserts or accessories for the boots.

75. Boot allowance increased to $200.00.

76. Article 61. Section 3. Increase from $275 to $750 net pay.

77. Article 61. New item add a minimum of 40 hours training for all repairman & technicians (job related) work annually.

78. Article 62. Section 1. New Wage Progression changed to 1st year 70%, 2nd year 90%, and 3rd year 100%.

79. Article 62. Section 2. Transportation porters eliminate the tier structure and make their pay equal to top porters pay.

80. Article 62. Section 2. Remove all tiers.

81. Starters and Secretaries all receive the same rate of pay at the dispatcher's rate.

82. Station Attendants receive the same pay as an operator.

83. When no relief is provided take coach to the end of the line and pull into your home division.

84. Substantial Wage Increase.

85. Increase pay 10% annually.

86. Night differential 2nd shift = 10% starts after 3 PM, 3rd = 15% shift starts after 11 PM.

87. Technician pay = grandfather in all "A" Repairmen who was on the payroll as of 9/16/2002 with retroactive pay.

88. Article 62. Section 8. Add sentence that work injury follow up appointments lost time will be paid and transportation provided by MTA.

89. Vault Pullers should be raised to 100% of operators pay.

90. Article 62. Section 9. Exceeding 30 weeks should be changed to until returns to work.

91. Any employee assaulted will automatically receive supplemental pay (assault pay).

92. Article 62. Section 6. Change 60 cents to $1.75.

93. Union employees should not be responsible for approving, supervising, or explaining to contractors how to do their work.

94. R-l. 1 Extra train operators will work as line operator and yard operator and station attendants after all station attendants are exhausted.

95. R-30. New Article Establish extra list for station attendants.

96. Only 1 test to become a technician and the test will be directly related to the job they perform.

97. E-Z.  Pass for all employees.

98. Bring back cost of living with 5% cap based on inflation rate.

99. Employees should be granted 1 family pass to travel on any of the MTA's systems. Such to be issued at least once every quarter of every three months.

100. Increases in Holidays add Thanksgiving Friday, Christmas Eve, and 2 floating holidays to be used anytime.

101. All Monday - Friday shops one shift shops (at most 2 shift shops) to be off on working holidays. If indeed working is required then seniority prevails for those who want off.

102. Retroactive pay from July 1, 2008 until ratification of new contract for all employees on the payroll.

103. Pending investigation if MTA desires to take employee out of service they are put on administrative leave.

104. Need language for MTA to pay employees regular pay until Workers compensation begins.

105. Severed employees will be eligible for group rate health insurance.

106. Severed employees are eligible for rehire when they recover from illness or injury.

107. Paid lunch breaks for all employees.

108. Paid bathroom breaks
